Terms and conditions

Article 1

The Night of the Refugee is an initiative organized by the Netherlands Refugee Foundation, located at Laan van Nieuw Oost-Indië 131, 2593 BM The Hague.

 

Article 2

Registration strictly takes place under the conditions of these regulations, as set out by the Netherlands Refugee Foundation.

 

Article 3

Participation in the Night of the Refugee is only possible for registered participants.

 

Article 4

Every participant (hereinafter referred to as 'Participant') in the Night of the Refugee (hereinafter referred to as 'the Night'), consisting of a 40km walk from Amsterdam to Haarlem, from Rotterdam to The Hague, from Utrecht to Amersfoort, From Camp Westerbork to Groningen, and from Nijmegen to Arnhem, and an evening walk of 10 and 20km in Rotterdam and Amsterdam, will adhere to the regulations set out by the Netherlands Refugee Foundation (hereinafter separately or collectively referred to as 'Foundation').

 

Article 5

Participation in the Night is only possible if the Participant has fully and truthfully completed the registration form and has therefore agreed to the general terms and conditions. Upon registration, the Participant declares that he/she is familiar with the general terms and conditions and adheres to the applicable regulations.

 

Article 6

Participants who register in the regular Night must be at least 18 years of age. If indicated in advance, minors may also participate under guidance. For the earlier evening Night of the Refugee walks, the minimum age allowed is 6, and adult supervision is required.   

 

Article 7

Each participant is fully aware that the Night is a test of his/her mental and physical strength, and that there is a risk of material damage or injury. Each participant declares that it is his/her own responsibility to determine whether his/her mental and physical conditions is sufficient for participation in the Night. 

 

Article 8

Each participant acknowledges the risks and aspects associated with participation in such an event. The Participant acknowledges that walking 40km through the night can be dangerous and declares to take part in the Night at his/her own risk. 

 

Article 9

Each Participant is responsible for his/her personal belongings and equipment during the Night.

 

Article 10

The Foundation is at all times authorized to penalize violation of the provisions set out in these terms and conditions or seriously unsporting behavior or inappropriate behavior, prior to or during the event, with disqualification. If a Participant does not expect to complete the distance of 40 kilometers, the Foundation reserves the right to withdraw him/her from the walk.

 

Article 11

The Foundation reserves the right to cancel the Night, including but not limited to: situations of force majeure, bad weather conditions, or for safety reasons. In case of cancellation of the Night or cancellation by the Participant him/herself, a refund of the collected sponsor money is not possible. 

 

Article 12

When necessary, the Foundation reserves the right to change certain parts of the route. The Participant must follow the indicated route at all times. 

 

Article 13

Should an acute crisis arise that requires more aid, the Foundation reserves the right to change the intended destination of the Night's proceeds. 

 

Article 14

In light of the safety of Participants and permits required for the event, a maximum of 1,500 people may participate per location. In case the maximum number of applications is reached, the Foundation reserves the right to select participants who have raised the most sponsor money. The Foundation also reserves the right to exclude participants who have raised between 0 and 10 euros in sponsor money. In case of voluntary or mandatory exclusion of participation, the sponsor money will not be refunded.

 

Article 15

By using the opportunity to participate in the Night, the Participant declares:

 

  1. a) That he/she is aware of the risks that participation in the Night entails and that he/she participates fully at his/her own risk;
  2. b) That he/she is in good (mental and physical) condition to participate in the Night;
  3. c) That he/she is not under the influence of alcohol and/or drugs during the walk;
  4. d) That he/she waives any right to claim against the Foundation, including affiliated companies, directors, officers, representatives, shareholders, and employees, on the grounds of damage suffered during or as a result of the Night;
  5. e) That he/she acknowledges that the Foundation, according to standards of fairness and reasonableness, reserves the right to exclude the Participant from participation (payments will not be refunded);
  6. f) That he/she acknowledges that the Foundation and all its representatives reserve the right to cancel the Night and that the Foundation has no obligation to allow the Night to take place at a different location or on another occasion if the Night cannot fully proceed.

 

Article 16

These general terms and conditions are also applicable to companies that register as a team of employees for the Night (hereinafter referred to as 'Participating Companies'). Upon registration, the Participating Company declares that each individual Participant of the Participating Company has declared him/herself to be familiar with and to have agreed with the provisions set out in these general terms and conditions. The Participating Company indemnifies the Foundation against liability for damage that third parties may suffer as a result of an act or omission attributable to a Participant in relation to the Night, as well as for damage that the Participant may suffer as a result of his/her participation in the Night, unless this damage is the direct result of intent or gross negligence attributable to the Foundation. The Participant's Participating Company declares to be adequately insured against the risk of liability for said damage.

 

Article 17

Each Participant gives permission to be photographed and/or filmed and will cooperate accordingly. The Participant authorizes the use of his/her personal data, visual material, voice, and biographical material within the context of media coverage, publicity and other overarching promotional and organisational activities of the Foundation. The Participant acknowledges that the Foundation alone decides whether images that depict the Participant appear in or are used for promotional purposes. All image materials related to the Night and all copyrighted materials shall remain the property of the Foundation. Every Participant grants permission to the Foundation to publish his/her name and competition results. For example, through publication in newspapers and via the Internet. 

 

Article 18

In all cases where the general conditions of the Night of the Refugee are not provided for, the Foundation shall decide.
